Limited warranty
EngineQuest warrants to the original purchaser that, during the warranty period, the product sold by the company shall be free from defects in material and workmanship, under normal use and periodic maintenance, as recommended by the original equipment manufacturer (OEM).
Warranty period
12 months from the date of purchase or the length of the engine warranty, whichever comes first.
This warranty is the only warranty provided by EngineQuest.. Except for this warranty, EngineQuest makes no warranty whatsoever, with respect to the product, including any warranty of merchantability; warranty of fitness for a particular purpose; or warranty against infringement of intellectual property rights of a third party; whether express or implied by law, course of dealing, course of performance, usage of trade, or otherwise.
Standards
Subject to limitations listed herein, EngineQuest,, at its option, shall repair or replace a product within the warranty term, after determination that the product is defective. All repairs and/or replacements covered by this warranty must be authorized in advance by EngineQuest. Remanufactured oil pump and timing cover warranty is void if a pump cover has been removed or altered in any way. The crankshaft warranty requires installation of a new harmonic balancer.
Limitations
This warranty isn’t transferable and doesn’t apply to or include any of the following: (1) Damage as a result of an act of God, misuse, abuse, accident, overheating, lack of lubrication, contamination or improper use, installation, operation, or maintenance; (2) Repair or replacement of any accessory, including, but not limited to: (a) all components of the cooling, fuel, electrical, and ignition systems; and (b) all belts, hoses, and filters; (3) Any product used for competition racing or similar purposes; (4) Any product, on which a device or accessory, not conforming to original manufacturer’s specifications, was installed; (5) Any product that wasn’t periodically maintained, as required by the original manufacturer; and (6) Any product that was modified or disassembled without the prior written authorization from EngineQuest.
Limited liability
EngineQuest’s liability under this warranty is limited solely to the repair or replacement of a defective product. The company shall not be liable for special, indirect, incidental, exemplary, or consequential damages, regardless of whether such claim is based in contract, warranty, tort, negligence, strict liability, or any other theory of liability, even if EngineQuest has been advised of the possibility of such damages.
These terms are governed by Illinois law (without regard to conflict of law principles). This warranty gives you specific legal rights. You may also have other rights, which vary from state to state.
Nor dealer nor any agent or employee thereof, is authorized to extend or modify this warranty. This warranty may be distributed in a state(s), which may not allow the limitation or exclusion of some warranties or of incidental, or consequential damages. In the event that any provision of this warranty should be or become invalid or unenforceable, the remaining terms and conditions hereof shall remain in full force and effect.
